During this seminar, we will delve deeper into the complex issues surrounding intellectual property and the use of photographs, particularly those of buildings/interiors and works of art. We plan an interactive session in which we will explore together the do's and don'ts regarding the use of photographs for research projects.

Research seminar IP, copyright and portrait rights in images

During this seminar, we will delve deeper into the complex issues surrounding intellectual property and the use of photographs, particularly those of buildings/interiors and works of art. We plan an interactive session in which we will explore together the do's and don'ts regarding the use of photographs for research projects.
During this session the following aspects will be discussed:
  • copyright: Who should you, as a researcher, ask permission to use photos in publications? Is there a difference between use for research purposes and broad use (e.g. publication on a website)? What about public buildings? In what way should this permission be sought? What rights do photographers have regarding their photographs of buildings? And as a researcher, what right do I have over my own photographs?

  • Portrait rights: To whom should you, as a researcher, ask permission for portraying people in photographs? What about situations where people are accidentally captured as part of a photograph of a building? What about events?

  • Some templates of informed consents were prepared and will also be explained.

We also invite you to submit concrete cases from your research. You may provide these to us no later than March 1st 2024 (email to lieve.weytjens@uhasselt.be or uschi.wallach@uhasselt.be)

About Tobias Van Royen

Speaker Tobias Van Royen studied law at the University of Antwerp, did an LLM in Tax law and holds a degree in Culture Management. He started his career in the creative sector as a consultant at Cultuurloket. Nowadays he is co-founder of the legal consultancy firm Twee-eiige Drieling (TWIIID), where he provides artists, creative enterprises and arts organizations with legal advice. TWIIID is also frequently asked to conduct fundamental research and to partake in residencies (Kunsthal Gent, F.eks Aalborg, et cetera), where they reflect on the artistic practice and experiment with providing an artistic framework around the legal practice. Results and films of this research can be found on twiiid.be.

He also works at the University of Antwerp where he lectures the legal framework of the culture sector.

  • For participants who will attend both workshops, lunch will be provided.
