Title

Public procurement for defence and security in the context of enhanced integrated cooperation within the European Union and NATO. (Research)

Abstract

The doctoral research project is based on two overarching objectives. Firstly, it aims to provide a detailed insight into how the appearance and evolution of the regulatory framework regarding public procurement for defence and security at EU level. It analyses the legal rationale and the underlying interconnections between the regulatory dimension and the institutional and political mechanism of the EU. Secondly, building on these conclusions, the research will focus on future regulatory instruments and solutions, in the current political and strategic context, as well as in that of future developments. The first segment of the project tackles the fundamental concepts, such as: public procurement in the EU and the underlying conceptual framework (including: the multidisciplinary concept "defence and security", the legal instruments for EU Common Foreign and Security Policy/Common Security and Defence Policy, NATO defence and security strategies and their influence on national policies). The main body of the research project analyses the specific features of public procurement for defence and security and the correlations between the dynamics of EU and NATO mechanisms and regulatory initiatives, with a comparative law approach (inter alia, France, Romania and Belgium). The analysis is complemented by a theoretical and practical overview on defence projects funded by the EU. The final segment of the project focuses on the perspectives for the future development of the legal framework. It includes recommendations on improving the regulations in place, with several options being considered: further harmonization or more flexibility for member states.
