Towards a (Fundamental) Right to Digital Public Administration? (Research)
Abstract
The research aims to balance the advantages of implementing digitalisation in public administration with the significant obstacles that may arise in safeguarding the rights of citizens involved in digital administrative procedures. The study will analyse legal protection in the context of the emerging digital relationships between citizens and public authorities. The main principles derived from the prior analysis will be highlighted and used in designing the right to digital public administration. Lastly, the research will assess if the right to digital public administration should be recognised and protected as a (digital) human right or as a (digital) fundamental right, primarily emphasising the right to benefit from public administration digitalisation, the right to opt out from digitalisation, as well as the right to human interaction and empathy when accessing public services.
